Girl Admits In Court That She Filed Rape Case Against Live-In Boyfriend In A Fit Of Rage

NEW DELHI -- A man, who was a live-in partner of a 23-year-old woman, has been acquitted of the charges of raping and threatening to throw acid on her as she told a court that she lodged the complaint in a fit of rage after having a quarrel with him.

Additional Sessions Judge Sanjiv Jain absolved a Faridabad resident of the charges of raping and threatening the complainant, a freelance anchor, saying, "Star witness was the prosecutrix...She did not support the prosecution case in any manner and completely turned hostile."

The fast-track court judge, "Considering the testimony of PW 1 (woman) who has categorically stated that she was in live in relationship with the accused and he had established physical relations with him with her consent and she lodged the present complaint in a fit of anger after having quarrel with him, I am of the view that prosecution case is not proved against the accused for the offences..."

According to the prosecution, on January 9, 2015, a complaint was lodged by the woman, alleging that the accused, with whom she was staying, used to physically and mentally harass her.

He allegedly established physical relation with her forcibly and used to beat her up whenever she objected or resisted, it said, adding that he was a habitual drinker and had threatened to throw acid on her face.

After her statement was recorded before a magistrate, the accused was arrested.

However, in her deposition before the sessions court, the woman had said she lodged the complaint as she was angry after a quarrel with him. She denied rape and threat allegations.

"She wrote the complaint on the dictation given by the police. She had also given her statement to the magistrate on the advice of the police. She has categorically denied that accused had made physical relations with her several times forcefully and without her consent...," the court said.

During the trial, the accused had denied the allegations levelled against him.
